Cool Breeze™ Copyright Infringment Lawsuit:

BACKGROUND

In 1999, Musique Tropique™ recording artists Cool Breeze™, the 20-piece World Music pioneers who have used the trademark since 1977, became the plaintiffs in a trademark infringement action brought against defendants Interscope Records, A&M Records, Universal Music & Video Distribution, Organized Noize Productions, and Frederick Bell for unauthorized use of the trademark Cool Breeze™.

Defendant Frederick Bell, an Atlantal-based Hip-Hop artist, is using the trademark as his professional name, and the defendants are using the name Cool Breeze™ on record releases of Bell and in the promotion of these releases and the artist. This use is without the permission of the plaintiffs, and is the subject of an upcoming trial to be heard before a jury and presided over by United States District Judge Robert J. Kelleher of the Central District of California in Los Angeles, California.

Defendant Frederick Bell has defaulted in the suit, thereby waiving his right to oppose the claim of the plaintiffs to ownership of the Cool Breeze™ trademark. Despite Bell's default, the other defendants continue to use the Cool Breeze™ name on their record product.

The trial will be heard before a six-person jury in Los Angeles.
